TERMS AND CONDITIONS OF SALE

The terms and conditions of sale govern the commercial relationship between Easy Detect (with Tax ID number: B06939441, located at Passeig dels Ferrocarrils Catalans 143, 08940 Cornellà de Llobregat, Barcelona) and its customer. By placing an order, the Customer fully accepts the general terms and conditions of sale, demonstrating full knowledge of their content. Specific conditions may be established for each customer, as agreed in the customer registration form. These conditions come into force on 1 January 2024. The sale of products by Easy Detect is subject to these general terms and conditions of sale, which prevail over any other general conditions, unless expressly waived in writing by Easy Detect.

ORDERS

Orders can be placed through our available channels. It is imperative that orders, except those placed online, be processed in writing by email to pedidos@easy-detect.com or directly at our facilities or sales offices. If a Customer wishes to place a special order outside the Easy Detect catalogue, they must request it from the Sales Department, and such order shall be irrevocable, subject to written authorisation and acceptance of the aforementioned general terms and conditions of sale. Placing an order implies full acceptance of the general terms and conditions of sale, prices and product specifications. Orders are subject to product availability. In the event of changes to delivery times, Easy Detect must receive the Customer’s written acceptance of the new delivery dates in order to consider the order valid. Once accepted, the Customer may not cancel the order.

PRICES

Prices are taken from our Price List. Any variation in the cost of the product may lead to a price revision. Prices and features are subject to change without prior notice. Products will have a net price according to the discount agreements between Easy Detect and the Customer, which can be consulted on our website or in offers/quotes from the sales department. The prices indicated on the website, catalogues and price lists are retail prices (RRP) and do not include VAT. Offers are valid for a maximum of 30 days and are subject to change without prior notice. In the event of an order with an incorrect price, Easy Detect will inform the Customer of the correct price and will proceed according to the Customer’s express acceptance. If the new price is not accepted, the order will be cancelled. Technical assistance outside our offices will be invoiced according to established rates, plus travel expenses and per diems, unless otherwise agreed between the customer and Easy Detect.

TAXES

The customer shall pay the amount resulting from all applicable taxes added to the price according to the tax zone, unless they have provided Easy Detect with exemption certificates accepted by the tax authorities.

PRODUCTS

Easy Detect reserves the right to determine which products form part of its catalogue and which will be offered to Customers (distributed and manufactured). In particular, Easy Detect may modify the products manufactured without prior notice. The specifications in catalogues, advertising brochures, etc., are for guidance only and do not constitute contractual documents.

TRANSPORT

All goods will be supplied:

1. Carriage paid for sales over 500€ net (for mainland Spain)
2. Carriage charged on invoice for sales under 500€ net.
   1. Less than 250€, an amount of 6€
   2. From 250€ to 500€, an amount of 12€.
3. Islands, Ceuta, Melilla: (Please enquire)

PAYMENT METHODS

The Customer may always make payment by legal means; cash payments will not be accepted. If you have a credit line, you may use your usual purchase methods. After placing the order, the Customer shall pay the total amount by transfer to one of the specified Easy Detect accounts. After receiving the bank receipt and verifying the payment, the order will be processed. If credit is requested, the payment method will be assessed using our own or contracted means. Payments shall be made in euros within 30 days of the invoice date, unless another condition permitted by law is agreed. Easy Detect reserves the right to assess the Customer’s creditworthiness at any time and, if insufficient, may modify the terms of credit without notice and request guarantees, insurance or advance payments. Unpaid invoices will generate financial expenses and the Customer will bear the costs of collection, including solicitors’ fees.

WARRANTY

The warranty coverage is limited to manufacturing defects and shall not apply to products that have been damaged due to misuse, incorrect installation, negligence, normal wear and tear, internal tampering, repairs carried out by third parties or use in applications other than those for which the product was designed. The warranty period will depend on that offered by the manufacturer and will be detailed in the list of categories. Easy Detect reserves the right to repair or replace damaged products during the warranty period. The warranty associated with each product shall be governed by the terms established by its manufacturer and shall automatically come into effect at the time of sale of the product. It is established that the warranty for consumables, batteries, and some accessories is limited. (see category list)

RETURNS

Returns must be requested within 20 calendar days of receipt of the goods by the customer. Returns, even under warranty, will not be accepted if sent carriage forward without a specific return number. The issuance of a return number does not imply acceptance; Easy Detect will verify the condition of the product and notify the customer of acceptance or refusal. In any case, a 15% deduction of the net value will be applied to the returned goods. Transport costs will be borne by the customer. Returned products must be in perfect condition, with their original packaging and manuals. Returns of products with broken seals, installed or tampered with, or products requested outside the catalogues will not be accepted. Easy Detect reserves the right to accept or reject returns.

LIMITATIONS OF LIABILITY

Easy Detect and its affiliated companies are exempt from any liability for direct or indirect damage caused to persons or property by installations carried out with the materials and equipment sold. It is understood that the installer is aware of the legal limitations and regulations established for installation at the time of product assembly. Agreed sales are conditional upon full payment of the price within the established deadlines. The goods remain in the Customer’s possession as a deposit, and the Customer undertakes to keep them and not to transfer or dispose of them until full payment has been made. The validity of the contract is subject to the laws of the State. Both parties accept the jurisdiction of the courts of Barcelona, Spain, to resolve any disputes that may arise from these sales.

REPAIRS (RMA)

Requests for a Return Material Authorisation (RMA) number must be made using the appropriate form. Before sending any material to Easy Detect, it is mandatory to obtain an RMA number assigned by the company. No RMA will be accepted without this number, and any package sent without it will be returned carriage forward. Easy Detect reserves the right to accept or reject products for repair at any time. Material must be sent to the head office in Spain. Shipments or deliveries to Easy Detect branches will not be accepted. The shipping costs for the RMA are the responsibility and risk of the Customer. RMAs that do not reach Easy Detect within 20 days of the request will be considered cancelled. Once the RMA process has been completed, the material will be returned to the Customer with the next order. If the Customer wishes to receive it earlier, the shipping costs will be at their expense, and they must contact the relevant department at Easy Detect to process any additional requests.
